In short: Bare Health is software, not a medical provider. Your practice and its licensed partners make all care decisions. Use the platform honestly and securely, and contact your practice with questions about care or billing.
These terms
These Terms of Use are an agreement between you and Bare Health Technologies, Inc. ("Bare Health," "we," "us"). They apply when you visit barehealthtechnologies.com or use the Bare Health platform. By using either, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use them.
What Bare Health is, and is not
Bare Health is software that connects practices with providers, pharmacies and laboratories. Bare Health does not provide medical care, prescribe or dispense medication, or give clinical advice. Licensed professionals at your practice and its partners are solely responsible for clinical decisions, including whether a treatment is appropriate for you. Using the platform does not guarantee that a treatment will be prescribed.
The platform is not for emergencies. If you may be having a medical emergency, call 911 or go to the nearest emergency department.
Your account
- You must be at least 18, or use the platform through a parent or guardian who has authority to act for you.
- Give accurate information, keep your sign-in details private and tell your practice or Bare Health promptly about any unauthorized use.
- If you are both a professional and a patient, use a separate sign-in for each.
- Representatives may act only within the permissions a patient or practice has given them.
Preview features
Some features are labeled as preview, alpha or test. They are offered so you can try them early, may change or be removed, and should not be relied on for patient care until the label is removed.
Acceptable use
You agree not to:
- access information you are not authorized to see, or try to get around security or access controls;
- impersonate anyone or misstate your credentials or licenses;
- upload malicious code, overload the platform, or copy or reverse engineer it;
- use the platform for anything unlawful, including obtaining medication by deception.
We may suspend or limit access to protect patients, practices or the platform.
Practices and care partners
Practices, provider groups, pharmacies and laboratories use Bare Health under separate signed agreements, including a subscription or partner agreement and a business associate agreement. Where those agreements differ from these terms, the signed agreements control.
Each practice and partner is responsible for its own licenses, professional judgment, records and compliance with the laws that apply to it.
Plans, fees and the founding member offer
- Plan prices, setup fees and platform fees shown on our website are for information. The prices and terms that bind you and us are the ones in your signed agreement.
- Payment-processing fees are separate from Bare Health's platform fee.
- Founding member offer. A practice that signs its agreement and pays a $1,000 deposit before Bare Health's official launch pays 50% of the one-time setup fee for its plan. The deposit is credited toward the setup fee and is refundable in full on request at any time before the practice goes live. Monthly plan fees and per-order platform fees begin on the go-live date, and any remaining setup fee is due then. The offer applies to new practice accounts, cannot be transferred or combined with other offers, and may be changed or ended for practices that have not yet signed.
Patient payments
Your practice sets the price of its treatments and services. A third-party payment processor handles payments on the practice's behalf, and Bare Health never stores full card numbers. Refunds, cancellations and billing questions are handled by your practice under its own policies, so please contact your practice first.
Electronic records and signatures
You agree that we and your practice may provide notices, consents and records electronically, and that typing your name or selecting a button to sign has the same effect as a handwritten signature. You may ask your practice for a paper copy of a document you signed.
Email and text notices
We send service notices such as sign-in codes, reminders and alerts. If you opt in to text messages, message frequency varies and message and data rates may apply. Reply STOP to stop or HELP for help. Notices never include care details.
Our platform and your content
Bare Health and its licensors own the platform, the website and the Bare Health name and logo. We give you a limited, non-transferable right to use the platform for its intended purpose.
You keep ownership of what you submit. You give us permission to store, display and transmit it as needed to run the platform for you and your care team. If you send us suggestions, we may use them without obligation to you.
Third-party services
The platform works with services from other companies, such as payment processing, video and sign-in with Google. Your use of those services may also be subject to their terms.
Suspension and ending use
You may stop using the platform at any time. We may suspend or end access if these terms are violated, if required by law, or to protect patients or the platform. Health records are kept as the law and our agreements with practices require, even after an account is closed.
Availability and changes
We work to keep Bare Health available and secure, but we cannot promise it will always be uninterrupted, for example during maintenance or events outside our control. We may improve or change features over time.
Disclaimers
To the extent the law allows, the platform and website are provided "as is" and "as available," without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Bare Health is not responsible for the clinical decisions, acts or omissions of practices, providers, pharmacies or laboratories.
Limitation of liability
To the extent the law allows, Bare Health will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the platform or these terms will not exceed the greater of the amount you paid Bare Health in the 12 months before the claim or $100.
Nothing in these terms limits rights that the law does not allow to be limited.
Responsibility for misuse
If you use the platform on behalf of a business, you agree to cover Bare Health's losses and reasonable legal costs from third-party claims caused by your violation of these terms or the law.
Governing law and disputes
Minnesota law governs these terms, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Minnesota, and you and we consent to those courts. Please contact us first so we can try to resolve the matter informally.
Changes to these terms
We may update these terms and will post the new version here with a new date. For significant changes, we will give notice in the platform or by email before they take effect. Continuing to use Bare Health after a change takes effect means you accept the updated terms.
General
If part of these terms cannot be enforced, the rest remains in effect. You may not transfer these terms without our consent. We may transfer them as part of a reorganization or sale. These terms, the Privacy Policy and any signed agreement are the entire agreement between you and us about the platform.
